This text is the Legal Notice for the website owned by NAVARRE UNIVERSITY HOSPITAL (CLINICA UNIVERSIDAD DE NAVARRA, hereinafter “CUN”), found at the URL www.cun.es.

The CUN is an institution whose registered office is located at 36 Avenida Pio XII, 31008, Pamplona, with Company Tax Code (CIF) R3168001J and registered in the Register of Religious Organizations of the Ministry of Justice under number 1787 of the special section, group C.

Accessing and browsing the website does not require Registration except to use certain functions and/or services, where the required data must be provided, such as one’s name and email address.

Minors under 14 years of age are not permitted to access and browse the website unless they have the prior and express authorization of their parents, guardians or legal representatives, who will be considered responsible for the actions that the minors in their care undertake, pursuant to applicable laws. In all cases when a minor accesses the website, it will be presumed to be with the prior and express authorization of their parents, guardians or legal representatives.

  • Not to defame, abuse, annoy, harass, threaten or otherwise violate any right of other Users or of any other persons.
  • Not to remove or attempt to delete any security measures adopted and implemented on the website.
  • Not to manipulate the hardware or software necessary to use the website.
  • To diligently use their passwords and keep them secret and not to reveal them to any third parties.
  • Not to assign the use of their ID and password to third parties temporarily or permanently, nor to allow access to these by third parties.
  • To notify the website managers immediately of any occurrence enabling the improper use of IDs and passwords, such as theft, loss or unauthorized access thereto, such that they can be immediately cancelled.

4. VIDEO CHAT USE

All messages that video chat users publish express the author’s point of view. Therefore, the CUN shall not be held liable for the content of any video chat message published.

Users are also informed that if they voluntarily provide their own or third-party data when using the service, this will be done at their own risk. The CUN will not, itself, perform any additional processing of such personal data beyond that which is entirely necessary for technical operations and service management. In any case, the processing of data will be carried out in strict compliance with the provisions laid down in Organic Law 15/1999 of December 13 on Personal Data Protection.

Users must behave properly and appropriately when using the service. Specifically, inappropriate, obscene, offensive, abusive or insulting comments or content should not be included. In all cases, persons creating such content will be fully liable for their actions. 

In any case, the video chat administrators and moderators reserve the right to exclude or not allow access to the www.cun.es video chat for Users violating current regulations, moral standards, generally accepted customs or public order, or the specific rules specified in this Legal Notice.

In this sense, the www.cun.es video chat administrators and moderators reserve the right to delete, edit, move or close any message posted that may infringe the rules detailed herein, and to block access to any other Registered User whose access is considered inadvisable for reasons related to the website’s image and reputation. 

The CUN will not be responsible, to any extent, for any consequences stemming from video chat use infringing these rules that is inappropriate, improper or generally in violation of the parameters of regular use and the operation of similar services.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The CUN is the owner of, or has obtained the corresponding intellectual and industrial property usage rights to, the website, as well as the intellectual and industrial property rights to the information and materials hosted; the structure, selection, ordering and presentation of the content, services and products available via the website; and the computer programs used in relation thereto.

The access, browsing, use, hosting and/or downloading of content and/or use of website services by the User will not, under any circumstances, be understood as a waiver, transfer, license or full or partial assignment of the aforementioned rights on behalf of the CUN or, as applicable, of the holder of the corresponding rights. References to names and trade names or registered trademarks, logos or other distinguishing marks, whether CUN- or third-party-owned, are implicitly prohibited without consent from the CUN or from their legitimate owners. Unless expressly stated, accessing or using the website and/or contents and/or services shall in no way grant the User any rights over the trademarks, logos and/or distinguishing marks included therein and protected by Law.

All intellectual and industrial property rights are reserved, and amending, copying, reusing, exploiting, reproducing, transforming, publicly communicating, making second or subsequent publications, uploading files, sending by email or post, transferring, using, processing or distributing in any way all or part of the content and products included on the website for public or commercial purposes is prohibited without express, written authorization from the CUN or, as applicable, the holder of the corresponding rights.

If the User sends information of any kind to the CUN via the website, through the channels provided for such a purpose on the website itself, the User declares, guarantees and accepts that they have the right to do so freely; that they are not infringing any intellectual property rights, trademark, patent, trade secret or any other third-party right; that such information is not confidential and that such information is not damaging to third parties. 

The User accepts responsibility and will hold the CUN harmless for any communication supplied personally or in their name, accepting such responsibility without any restriction concerning its accuracy, legality, authenticity and ownership.

7. RESPONSIBILITIES AND GUARANTEES

The CUN cannot guarantee the reliability, usefulness or accuracy of the information provided through the website, or the usefulness or accuracy of the event documentation, prepared by professionals from a wide range of sectors, that may be acquired via the website. 

Consequently, the CUN does not guarantee or take responsibility for (i) the continuity of website content; (ii) the absence of errors in such content or products; (iii) the absence of viruses and/or other harmful components on the website or in the supplying service; (iv) the invulnerability of the website and/or the impenetrability of the security measures adopted therein; (v) the lack of usefulness or performance of the website content or products; (vi) the damages or harm caused to themselves or a third party by persons infringing the conditions, rules and instructions that the CUN lays down on the website or by violating the website security systems. 

Nevertheless, the CUN states that it has taken all necessary measures, to the extent possible and given the state of technology, to guarantee the website’s functioning and avoid the existence and transmission of viruses and other components that may harm Users. If the User becomes aware of the existence of any illicit, illegal or unlawful content that may constitute an infringement of intellectual and/or industrial property rights, the CUN must be notified immediately in order to adopt the appropriate measures.

Lastly, the CUN does not guarantee the provision of the services offered, such as requesting an appointment, as such services depend on the actual availability of specialists, among other circumstances. In this regard, while the CUN will make every effort to deliver, it shall not be held responsible for the cancellation and/or change of appointments scheduled for patients. Nor shall the CUN be responsible for the opinions provided by health professionals directly via the website and in response to individual queries from users. The website is merely informative, and under no circumstances shall it replace the physician–patient relationship.

8.1. Links to other websites

If Users find links to other websites via different buttons, links, banners, etc., these are third-party-managed. The CUN does not have the authority or the human or technical resources to have knowledge of, to review or to approve all the information, contents or services provided via other websites linked to from the website. 

As a result, the CUN cannot assume any liability for all matters related to external websites visited via links placed on its own website, specifically including, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, links and/or any of its content in a broader sense. 

In this sense, if Users become aware of the illegal nature of activities carried out through these third-party websites, the CUN must be notified immediately in order to disable the access link thereto.

Establishing any type of link from the website to another website does not mean there is any type of relationship, collaboration or dependence between the CUN and the person responsible for the external website.

The page on which the link is placed must not in any way state that the CUN has authorized such a link unless the CUN has done so expressly in writing. If the institution correctly links to the website from its website and wishes to include the brand, name, trade name, label, logo, slogan or any other CUN and/or website identifier, then prior, express and written authorization shall be required. 

The CUN does not authorize any placing of links to its website from external web pages with illicit, illegal, degrading or obscene materials, information or content, or such material that in general contravenes morals, public order or generally accepted social norms. 

8.3. Third-party services provided through the website

The CUN does not guarantee the legality, reliability or usefulness of the services provided, of the content supplied through third parties on this website or where the CUN only serves as an advertising channel. 

The CUN will not be responsible for any damages or losses of any kind caused through the services provided, the third-party content published on the website or, in particular, including, but not limited to, damage caused by: 

Failure to comply with the Law, morals or public order. 

The introduction of viruses or any other computer code, file or program that may damage, interrupt or prevent the normal operation of any software, hardware or telecommunications equipment.
 Infringement of intellectual and industrial property rights or contractual commitments of any kind.

11. INTERNAL REPORTING CHANNEL OF THE CLÍNICA UNIVERSIDAD DE NAVARRA

In compliance with the provisions of Law 2/2023, of February 20, regulating the protection of persons who report regulatory infractions and the fight against corruption, the Clínica Universidad de Navarra has implemented an internal CUN Information System, which is the preferred channel for individuals to communicate information obtained in a work or professional context about any of the actions or omissions referred to in Article 2 of the Law, basically criminal infractions, serious or very serious administrative infractions, and infractions of European Union Law: https://canalinternodeinformacioncun. canaletico.app/

12. DURATION AND AMENDMENT

The CUN may amend the terms and conditions set forth herein, in full or in part, publishing any changes as appears in this Legal Notice or through any type of communication sent to Users. 

Therefore, this Legal Notice will be valid for the length of time indicated until amended in full or in part. The amended Legal Notice will then take effect. 

Regardless of the provisions set forth in the specific conditions, the CUN may terminate, suspend or interrupt access to the website content at any time without prior notice, without Users being able to demand any compensation. After such termination, the prohibitions on content use set forth herein shall remain in force.

13. GENERAL CONSIDERATIONS

The headings of the different clauses are for information purposes only and will not affect, qualify or expand the interpretation of the Legal Notice. 

If there are any discrepancies between the provisions of this Legal Notice and the specific conditions of each individual service, the provisions of the latter shall prevail.

14. JURISDICTION

The relationship established between the CUN and the User will be governed by the provisions laid down in current laws on the applicable legislation and competent jurisdiction. However, for cases where the law provides for the possibility of the parties submitting to a jurisdiction, the CUN and the User, with express waiver of any other jurisdiction they may have recourse to, will submit any disputes and/or litigation to be heard by the Courts of the city of Pamplona.

12. DURATION AND AMENDMENT

The CUN may amend the terms and conditions set forth herein, in full or in part, publishing any changes as appears in this Legal Notice or through any type of communication sent to Users. 

Therefore, this Legal Notice will be valid for the length of time indicated until amended in full or in part. The amended Legal Notice will then take effect. 

Regardless of the provisions set forth in the specific conditions, the CUN may terminate, suspend or interrupt access to the website content at any time without prior notice, without Users being able to demand any compensation. After such termination, the prohibitions on content use set forth herein shall remain in force.

14. JURISDICTION

The relationship established between the CUN and the User will be governed by the provisions laid down in current laws on the applicable legislation and competent jurisdiction. However, for cases where the law provides for the possibility of the parties submitting to a jurisdiction, the CUN and the User, with express waiver of any other jurisdiction they may have recourse to, will submit any disputes and/or litigation to be heard by the Courts of the city of Pamplona.
